Welcome to Vocardulary! These Terms of Service govern your access to and use of our mobile applications, website, and all related services. Please read them carefully.

1. Acceptance of terms & Eligibility

By installing or using the Vocardulary mobile applications (the "Service") you agree to these Terms of Service. <strong>Eligibility:</strong> You must be at least 15 years old (or the local digital age of consent). If you are under 15, you may only use the Service with the express consent of your parents or legal guardians, who must agree to these terms on your behalf.

2. Accounts & Security

You must create an account to access the Service. You are responsible for keeping your credentials confidential and for all activity under your account. Profile & Photos: you agree to only upload profile pictures that authentically represent yourself. It is strictly prohibited to upload photos of third parties, celebrities, unattended minors, or false representations, backgrounds without you, or inappropriate material, which can lead to immediate account termination.

3. License to use the app & IP rights

Subject to these terms, Vocardulary grants you a personal, non-exclusive, non-transferable, revocable, and limited license to download, install, and use the app on your personal devices solely for non-commercial language learning purposes. Any other use, copying, modification, or redistribution is strictly prohibited without our prior written consent.

4. In-app purchases, subscriptions & Cancellation

The Service offers consumable items (crystals, packages), durable items (decks, spells), and recurring subscriptions (Vocardulary Pro). Purchases are processed by the Apple App Store or Google Play and are subject to their respective billing terms. <br/><strong>Right of Withdrawal:</strong> Under EU and French consumer protection laws, you explicitly agree that the supply of digital content and subscriptions begins immediately upon purchase, and you hereby expressly waive your 14-day statutory right of withdrawal. <br/><strong>Automatic Renewal:</strong> Subscriptions automatically renew for the same duration and price unless cancelled at least 24 hours before the end of the current period via your Apple App Store or Google Play account settings. <br/><strong>Loot Boxes & Drop Rates:</strong> Any virtual chests or randomized item drops in the application display their drop rate probabilities transparently in the purchase interface to ensure fair play and compliance with consumer guidelines.

5. User conduct & Fair Play Charter

• No cheating, artificial boosting, exploiting bugs, or using automation tools (bots/scripts) for gameplay.
• No harassment, identity theft, hate speech, bullying, or obscene/offensive content in multiplayer modes, comments, or community areas.
• No reverse-engineering, scraping of dictionary data, reporting abuse, or unauthorized access to our systems and servers.

6. User content & Licensing

You retain ownership of any content you submit (text, custom card notes, comments). However, by posting or uploading content to Vocardulary (including profile pictures for avatar generation), you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, modify, display, and distribute that content solely for the purpose of operating, developing, promoting, and improving the Service.

7. Intellectual property

All source code, design, artwork, interfaces, speech synthesized by AI models, audio, text, databases (including dictionaries and vocabulary lists), and trademarks or logos associated with Vocardulary belong exclusively to Vocardulary or its third-party licensors. Nothing in these terms transfers or grants you any intellectual property rights, except for the limited license to use the app expressly granted under Section 3.

8. Termination

We reserve the right to suspend, restrict, or terminate your account immediately and without prior notice in the event of a material breach of these terms (including, but not limited to, verified cheating, uploading prohibited pictures, or identity theft). You may delete your account and all associated data at any time through the in-app settings or by visiting our dedicated page: delete account. In compliance with the GDPR, we commit to permanently deleting your personal data within 30 days of your account deletion request.

9. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, we make no representations or warranties regarding the absolute accuracy, reliability, completeness, or timeliness of word translations, definitions, speech-synthesized audio pronunciations, or visual assets generated by artificial intelligence models or third-party providers. Your use of these features is at your own risk.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Vocardulary or its officers be liable for any indirect, special, incidental, or consequential damages (including, but not limited to, loss of gameplay progress data, service interruptions due to Firebase/Azure third-party host failures, or AI API model processing errors) arising out of your use of or inability to use the Service. This limitation applies regardless of the legal theory invoked.

11. Changes to these terms

We may update these terms from time to time. If we make material modifications, we will notify you via email or in-app notice at least 30 days before they take effect. Continued use of the Service after this notification period constitutes acceptance of the updated terms.

12. Governing Law, Disputes & Contact

These terms are governed by and construed in accordance with French law. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Paris, France, unless mandatory local consumer protection laws provide otherwise.
